How does Mental Health impact the law

This means people who suffer with mental ill health at work can be protected and employers should be making reasonable adjustments in the workplace to alleviate any disadvantage they face.

Even where an employer doesn’t think the employee meets the definition, employers should be adopting best practises and exploring reasonable adjustment as this can prevent long term sickness and any deterioration in their mental health as well as increase productivity.

Where an employer refuses to make reasonable adjustments or dismisses an employee, either because of their mental ill health or because of something arising from their disability (like their sickness absence) this could amount to discrimination and both parties should take advice.
